Judge Rebecca T. Tin
Destroys Lives in
Mecklenburg County Family Court
Judge Tin ran the Complex Litigation Track. She was the only judge in America that could choose her own cases. She chose ten cases. Eight of the ten cases involved the law firm of James, McElroy and Diehl ("JMD"). All eight were overwhelming victories for JMD.
Families Destroyed in Mecklenburg Family Court
Would you believe that a family court judge (Judge Tin) ......
- Denied issuing a restraining order against a man who hadstolen a gun, threatened to kill his wife and children, and was a convicted felon. Seven days later, the mother was raped and murdered by her husband when she returned home to retrieve her children's birth certificates.
- Lied to the public in a Charlotte Observer article when she said "there was no way with the evidence in front of me to fathom that this man would snap the way that he snapped". A mother enters your court room and says that her husband threatens to kill her and her children, has stolen a gun, and has physically, sexually, and emotionally abused her on several occasions. Judge Tin said his words in addition to the lack of documented abuse led her to allow the two to continue living together. Judge Tin, he was a felon!
- In contrast, issued a restraining order against two children's entire maternal extended family (grandparents, aunts, uncles, cousins, etc) without any evidence being presented that these people posed a threat to the children. James, McElroy, and Diehl Law firm represented the father.
- Allowed an attorney to reference a Jewish father as "not unlike the Nazis going into Europe" in her courtroom. THen denied this man's children their right to a bar/bat mitzvah. James, McElroy, and Diehl Law firm represented the mother.
- During a case involving a young child who has problems with rage and anger outbursts, Judge Tin praises a father for encouraging weapons and hunting in the child's life.
- Gave custody to a man who was proven with 99.9% accuracy to not be the biological father (Taking custody from the child's mother). This same man had been caught driving drunk without a license with his child NOT in a car seat (The child's mother had no criminal history).
- Took custody from a mother because she believed her children. Then gave custody to a father who admittedly hit his child (leaving bruises), gave his 7 year-old child alcohol, and restricted asthma medication to the point that the child fainted. James, McElroy, and Diehl Law firm represented the father.
- Took custody away from a father because he allowed his 17 year old daughter to drink alcohol on vacation. The father lost custody of all three children. James, McElroy, and Diehl Law firm represented the mother.
- Took custody from a father for three years based on false allegations that he "banged" her in the "tummy". In this case, the allegations were found to be fabricated by the mother. However, the mother received full custody. James, McElroy, and Diehl Law firm represented the mother.
- Inflated a paralyzed father's child support obligations stating that he earned income by living "free" with his parents. He lived with his parents in order to receive 24 hour medical care. Judge Tin's ruling compromised this father's monthly disability earnings and access to appropriate medical care
- Praised a healthy father with unlimited earnings potential for living free of rent with his girlfriend. Judge Tin chose not to apply her living "free" rule in this case and inflated the mother's salary for her to pay the father child support. James, McElroy, and Diehl Law firm represented the father.
- Within one month's time, ordered payments in the neighborhood of 1 million dollars to the firm of James, McElroy and Diehl to pay spousal attorney's fees through family court cases.
In Judge Becky Tin's Court Room, the U.S. Constitution is Ignored:
- Judge Tin was allowed to choose her own cases under the Complex Litigation Track.
- Judge Tin abused this unconstitutional privilege by choosing ten cases, eight of which were represented by the James, McElroy and Diehl Law firm.
- All eight James, McElroy and Diehl cases resulted in overwhelming victories for James, McElroy and Diehl.
- Judge Tin does not listen to the evidence. In numerous cases she has read long decisions from the bench within minutes of the last witness sitting down. These written decisions must be written prior to hearing the evidence and have been up to 50+ page orders.
- Judge Tin made findings of fact before all the evidence has been presented.
- Judge TIn does not allow the separation of church and state in her court room. For example, she has denied children the right to participate in their own bar mitzvah and bat mitzvah through her child custody order.
- Judge TIn has filed her own motion & ruled on her own motion whilde calling other's defiant when asking for her recusal.
- Judge Tin has consistently used "rehabilitation therapy" in her family court. Parents are being forced to go to therapy to recant their perceptions in order to see their children.
- Judge Tin orders therapists to "commit to the findings of the court" as the truth, they are denied access to other important data, they cannot advocate for their client, and they must follow Judge Tin's treatment protocol.
- Judge Tin is not a therapist but often states in her court orders "The court thinks, the court finds, the court believes ....." dismissing testimony from experts and/or private therapists.
- In Judge Tin's courtroom, "the court" is above the law and the findings of fact are her own beliefs.
- Judge TIn has denied people the fundamental rights of access to legal representation (e.g. mother was ordered that she not incur any other liabilities, including legal fees if they interfered with her ability to pay an award of upward of $200,000.00 to father's attorney - namely James, McElroy and Diehl.
- Heartbroken parent: "Judge Rebecca Tin has destroyed my children's lives and they will never feel the same level of security and attachment that they once had prior to entering her court room. How can she call this family court?"
- What goes around comes around: "Yes, the courts are biased, but not for women, at least not in my case. My attorney told me one of the judges told all the other judges I was "lying" and believe me, I got shafted, over and over and over. Ex was just arrested for assaulting his new wife. Guess I wasn't lying after all. My son begged the judge ro let him live with me, and she laughed in his face. She destroyed my children. What goes around comes around, Judge Tin. It must suck to be you."
- Judge Tin conducts an illegal trial: "oh, pleeeeease. The entire court system is a joke. Court appointed guardian ad litems and fruitcake advocated in it for the money. The first words out their mouth is "here is my address so you can send your payment". In North Carolina, you can get Judge Becky Tin to conduct an illegal trial, complete with all the witnesses and testimony against you conducted in a private room with you not present."
- Protective parent loses custody: "I thought I was going into family court to protect my children and Judge Tin took my children away from me and awarded the abusive parent custody. It is sad to know that I am not alone and appreciate the person who has started this website. I only wish I had known this prior to entering her court room."
- Broken hearted grandparents: "I am a grandparent who was one of the primary care givers to my grandsons. Because of Judge Tin, these children were taken away without me or my husband, their grandfather being able to say goodbye. I was not able to see my grandchildren for over 8 months. The children have repeatedly asked to see us but the words fall on deaf ears. I can't imagine what psychological problems this is causing to my grandchildren."
- Children's lives are being destroyed: "I am a pediatrician who has testified in Judge Tin's courtroom. I explained to her that hitting a 3 year-old and leaving bruises is, by definition, abuse. Despite the fact that a father admitted to such acts, he was awarded full custody in her courtroom and praised as a good father. The same father let his 7 year-old play with pocket knives and he sustained cuts and secondary infections from his injuries. Who beats a child and is praised? A father who was represented by James, McElroy and Diehl and enters this Judge's courtroom."
